NEW: Republican AG Sues DOJ, Seeks To Preserve Jack Smith’s Records

Texas Attorney general Ken Paxton has filed a new lawsuit against U.S. Attorney General Merrick Garland and the Biden Department of Justice “to prevent potential destruction of any records from Jack Smith’s corrupt investigation into President Donald Trump.”

On November 8, Paxton filed a Freedom Of Information Act (FOIA) request to the DOJ seeking all records and communications relating to Smith’s “unconstitutional investigation into President Trump.” In a press release, the Lodestar State’s top lawyer noted that Special Counsel Robert Mueller — who oversaw the bogus Russian collusion investigation that was launched on a Clinton Campaign-funded dossier — was able to destroy all of his records without any accountability.

On Monday, November 11, Paxton followed up by requesting a preservation order that would prevent Smith from destroying his records and communications.

“I will not allow the corrupt weaponization of the United States government to be swept under the rug as Jack Smith and others who unjustly targeted President Trump attempt to avoid accountability,” Paxton said. “The American people deserve transparency, and those responsible for these unlawful witch hunts must not destroy the evidence of their own misdeeds.”

The filing states that Paxton’s Office is concerned that the requested records will “never see daylight.”

“That is not because DOJ has any legal reason to withhold them. Rather, Attorney General Paxton has a well-founded belief as set forth herein that Defendants will simply destroy the records. That is how they and/or their predecessors have operated in the recent past. And Jack Smith’s team has conducted itself in multiple ways that suggest it cannot be blindly trusted to preserve, and eventually produce, all of its records,” the filing continues.

The House Judiciary Committee has also ordered Smith to preserve his records and communications relating to his years-long probe into the Biden Administration’s political rival.

“The Committee on the Judiciary is continuing its oversight of the Department of Justice and the Office of Special Counsel. According to recent public reports, prosecutors in your office have been ‘gaming out legal options’ in the event that President Donald Trump won the election,” the committee wrote. “With President Trump’s decisive victory this week, we are concerned that the Office of Special Counsel may attempt to purge relevant records, communications, and documents responsive to our numerous requests for information.”

“We reiterate our requests, which are itemized in the attached appendix and incorporated herein, and ask that you produce the entirety of the requested material as soon as possible but no later than November 22, 2024,” they went on to say in the letter.
