WATCH: Legal Analyst Reveals How Obama Could Face Criminal Charges

David Schoen, a veteran trial attorney who defended President Donald Trump in his second impeachment trial, laid out how former President Barack Obama could be criminally charged for his role in the Russian collusion hoax.

While Obama was named as a conspirator by National Intelligence Director Tulsi Gabbard when she declassified a memo outlining how the Russian collusion hoax was crafted under false pretenses, the question of presidential immunity has remained. Obama was indeed named in a Justice Department referral over the case, though he may indeed be immune due to last year’s Supreme Court ruling on presidential immunity for official acts carried out while in office.

“”It probably helps him a lot. Probably helps a lot. The immunity ruling, but it doesn’t help the people around him at all. But it probably helps him a lot,” Trump said of his initial predecessor on Friday. “He’s done criminal acts, there’s no question about it. But he has immunity, and it probably helps him a lot… he owes me big, Obama owes me big.”

During a recent appearance on Newsmax, Shoen laid out a scenario that could lead to criminal charges being fired against the former president anyway. “President Trump is right when he said the immunity decision would help President Obama. But you know what it doesn’t help him with? Impeachment,” he said.

According to the Democratic Party and the House managers in the second impeachment trial, a former president once out of office is still subject to impeachment. In other words, they’ve argued Lincoln could be impeached, George Washington impeached. And certainly, as I predicted at the time, this would come back, they would rue the day because President Obama could be impeached if this evidence really says what it says,” the veteran attorney continued. 

And that it could also strip him of the immunity because under Article I, Section 3, Clause 7 of the Constitution, the Democrats argued it bars one from holding further office and the language itself says you’re still subject to criminal prosecution or indictment. So we’ll see how that plays out.”

Schoen also laid out the potential charges former Obama underlings, such as former CIA Director John Brennan, could face for signing off on a document claiming Russia influenced the 2016 election in favor of Trump despite having evidence to the contrary.

Let’s put President Obama to the side just for a second. As for the others, I mean, if the evidence really shows what is being talked about now, and it can be proven, then certainly those others could be charged with seditious conspiracy under 18 U.S.C. 2384,” Schoen said. “Undermining our government, undermining the will of the voters, certainly obstruction of justice, certainly perjury, they would all be entitled to the presumption of innocence, but those are the kinds of charges that could be brought.”

National Intelligence Director Tulsi Gabbard has described the conduct exhibited by Obama and his underlings as a deliberate effort to undermine the 2016 election and the will of American voters.

“This is not a Democrat or Republican issue. This is an issue that is so serious it should concern every single American because it has to do with the integrity of our democratic republic. What we saw occur here as the documents we released detailed was that we had a sitting President of the United States and his cabinet and leadership team, quite frankly, who were not happy with the fact that President Trump had won the election, that the American people had chosen Donald J. Trump to be the next President, Commander-in-Chief of the United States,” she said.

So the effect of what President Obama and his senior national security team did was subvert the will of the American people, undermining our democratic republic, and enacting what would be essentially a years-long coup against President Trump, who was duly elected by the American people.”
