NEW: DC Resident To Plead Guilty To Assaulting Trump Official
A D.C. woman will be entering a guilty plea to federal charges spitting on then-U.S. Attorney for the District of Columbia Ed Martin back in May. She will also be pleading guilty to assaulting two U.S. Marshalls while in custody.
Attorneys for Emily Gabriella Sommer, 33, said in court Tuesday that she will be pleading guilty to all three counts against her, all for assaulting, resisting or impeding a federal officer or employee. Judge Jia M. Cobb scheduled a hearing to accept her guilty plea for Thursday afternoon.
Sommer had initially pleaded not guilty and was set to begin a jury trial in the nation’s capital on Monday. She was arrested in May for spitting on Martin, who was wrapping up his tenure as the all important D.C. U.S. Attorney after Senator Thom Tillis (R-NC) refused to advance his nomination out of committee.
According to charging documents, Sommer approached Martin and asked, “Are you Ed Martin?” before lunging at him and spitting on his left shoulder.As she walked away, Sommer yelled, “You are a disgusting man. F*** you Ed Martin. My name is Emily Gabriella Sommer, and you are served.”
The entire incident was caught on video, as Martin with speaking with reporters in downtown D.C. at the time.
Sommer had another outburst during her initial court appearance on May 22, when she was informed that the prosecutor’s office intended to seek a more serious version of the assault charge that requires forcible contact and carries a maximum prison sentence of up to eight years, WUSA 9 reported. While in holding after being removed from the courtroom, Sommer allegedly spit and kicked on two U.S. Marshals.
A superseding indictment was filed in June that brought two additional assault charges in connection with the May 22 incident.
“Thank you to the prosecutors in USADC – job well done,” Martin said Wednesday after news of the plea agreement was released.
Sommer was initially granted supervised release back in May, despite objections from prosecutors, but has since been held in custody at the D.C. Jail since late June after she was arrested in connection with a second incident, in which she was accused of using a metal pole to damage the door of a neighbor she accused of surveilling her.
The D.C. resident was hit with additional charges days later for allegedly defacing that same neighbors door with spray paint.

As of late July, Sommer’s attorneys were attempting to negotiate an all-encompassing plea to resolve all of the charges levied against her. It is not currently known whether the plea she will enter on Thursday is part of those negotiations.
Martin has since been replaced with former New York judge and prosecutor Jeanine Pirro, who was confirmed by the U.S. Senate earlier this month. President Trump has since appointed Martin to head up the DOJ’s government weaponization working group.
Most recently, Attorney General Pam Bondi appointed Martin to serve as special counsel in the department’s investigations against Senator Adam Schiff (D-CA) and New York Attorney General Letitia James.
