Tennessee Judge Makes Shocking Ruling In Case of Violent MS-13 Gangbanger
Alleged MS-13 gangbanger, Kilmar Abrego Garcia, who has been accused of participating in a human trafficking ring, was let out of jail in Tennessee on Friday and is on his way home to his family in Maryland, according to his legal representative. Abrego Garcia was released from the Putnam County Jail after having been deported by the Trump administration, after he was initially returned to the U.S. to face charges of human smuggling.
“Today, Kilmar Abrego Garcia is free. He is presently en route to his family in Maryland, after being unlawfully arrested and deported, and then imprisoned, all because of the government’s vindictive attack on a man who had the courage to fight back against the Administration’s continuing assault on the rule of law,” his attorney, Sean Hecker, said in a statement given to Fox17.
“He is grateful that his access to American courts has provided meaningful due process,” he continued. A United States magistrate judge was expected to let him go as the case into his human smuggling activities moves forward.
President Donald Trump and his administration have made the case that while there was an administrative error that led to the man’s deportation, he should still be booted from the country due to his alleged ties to MS-13, one of the most disturbingly violent criminal gangs in the world. He has also been accused of human trafficking after he was stopped behind the wheel of a vehicle owned by a convicted human smuggler.
Abrego Garcia’s case is one of several challenges that have been brought against the president’s use of the Alien Enemies Act of 1789 to move with speed to send illegal aliens to a prison in El Salvador.
The suspect has been in custody ever since the administration returned him to the United States to face human smuggling charges in the state of Tennessee. Strangely, Abrego Garcia’s wife has been one of his strongest, most passionate advocates, despite telling police her husband abused her.
In a statement that was made in June 2025, White House Press Secretary Karoline Leavitt said, “Abrego Garcia was never an innocent ‘Maryland Man’– Abrego Garcia is an illegal alien terrorist, gang member, and human trafficker who has spent his entire life abusing innocent people, especially women and the most vulnerable. Abrego Garcia will now return to the United States to answer for his crimes and meet the full force of American justice.”
Homeland Security has made clear its intentions to see Abrego Garcia deported at the end of his criminal trial. Just before his release, lawyers representing the suspect hired private security for him, citing concerns that ICE agents may detain him once he returns to Maryland.
