NEW: Federal Prosecutor Who Resisted James Case Fired For Leaking Sensitive Information
A federal prosecutor with the U.S. attorney’s office in the Eastern District of Virginia — where interim U.S. attorney Lindsey Halligan is currently overseeing the criminal fraud case against New York Attorney General Letitia James — allegedly sent investigative files with James’ personally identifying information to her own private email account.
The prosecutor, Beth Yusi, was dismissed earlier this month due to the mishandling of sensitive information, sources familiar with her termination told CNN. Yusi had previously resisted the Justice Department’s efforts to bring charges against James, claiming there was “no evidence” to support charges despite the existence of documents listing a Virginia property as her primary residence.
James, 66, faces 60 years in prison if found guilty of falsifying documents submitted to mortgage authorities when she purchased a Virginia homestead in 2020. The acquisition came with a “second home rider” that stipulated she would use the home as her primary residence.
Additional financial disclosures released by James lists rental income from the property, despite the fact that the stipulations of the loan prevented her from using it as a rental, prosecutors allege.
Sharing evidence from an ongoing investigation is typically not a violation of the law if it does not include classified information, though it would constitute a violation of Justice Department policy. The department has not yet issued an additional comment on Yusi’s dismissal.
Margaret Donovan, an attorney for Yusi, disputed the details surrounding her client’s dismissal in a statement to CNN. Donovan claimed that Yusi “has no record of any such email” and “has never used her personal email account for any portion of any investigation.”
“Ms. Yusi is a well-respected prosecutor, a leader among her peers, and a consummate professional with nearly two decades of experience,” she added.
Prior to her ousting, authored an internal memo that explained why prosecutors believed there was not enough evidence to bring charges against James. The move sent the U.S. attorney’s office into disarray as career prosecutors attempted to sabotage the investigation, prompting Halligan’s appointment.
Veteran DOJ journalist Julie Kelly previously reported that Yusi and another prosecutor, Kristin Bird, were “fired, escorted from the building, and stripped of security clearances for leaking info on sensitive investigative matters to MSNBC.”
Specifically, the materials were leaked to MSNBC legal reporter Ken Dilanian, who is best known for promoting unverified claims from the infamous Steele dossier, funded by Fusion GPS, a research firm linked to Hilary Clinton. He was also caught submitting stories directly to the CIA in order tor employees to edit and provide changes to his stories before publication.
