Over the past two days, former President Donald Trump’s defense team has vigorously cross-examined Michael Cohen, Trump’s former attorney in the high-profile hush money trial. The testimony is seen as crucial as Cohen is the prosecution’s key witness. Courtroom exchanges have been intense, with Cohen detailing his role in the alleged payment to adult film actress Stormy Daniels prior to the 2016 election—a payment he claimed was directed by Trump.

On Monday and Tuesday, Cohen portrayed a narrative of a $130,000 payment meant to silence Daniels about her alleged affair with Trump, ostensibly to prevent any damage to Trump’s presidential campaign. However, the defense has painted a different picture, suggesting that Cohen, motivated by personal grievances and financial gain from his media appearances, is not a reliable witness.

However, during a House Judiciary Committee hearing on Wednesday, statements by Cohen’s former attorney, Robert Costello, have brought about significant doubts about Cohen’s testimony. Costello, during a line of questioning from Rep. Greg Steube (R-FL), claimed that Cohen had once confided that he didn’t actually believe Daniels’ allegations but chose to address the matter to avoid any embarrassment that it could cause Trump and his family, particularly Melania Trump.

During Wednesday’s session, Costello detailed his past conversation with Cohen, quoting him as saying, “‘I got a call from a lawyer representing Stormy Daniels, who represented that she was going to testify that Donald Trump had sex with Stormy Daniels.’ Michael Cohen said, ‘I didn’t believe the allegation, but I knew that such an allegation would be terribly embarrassing.'”

Moreover, Costello challenged Cohen’s claim of Trump’s direct involvement in the payment: “Did Donald Trump have anything to do with it? No. Did you get the money from Donald Trump? No. From any of his organizations? No. From anybody connected to Donald Trump? No.” He further clarified that Cohen financed the payment through a home equity line of credit to keep the transaction private from his family and the public, indicating Cohen’s unilateral decision-making.

Costello’s testimony and statements concerning Cohen’s actions and motivations could also impact the legal efforts led by Alvin Bragg, the Manhattan District Attorney. Costello’s claims that Cohen acted independently in the hush money payments and did not believe the allegations against Trump suggest complexities in the narrative that the DA’s office has presented.

Costello gained media attention as a legal advisor to Cohen. He has publicly discussed his interactions with Cohen, particularly around the time when Cohen was testifying against Trump. Costello has provided insights that have contradicted Cohen’s assertions in the past, particularly concerning Cohen’s motivations and the details surrounding his decisions to make payments to Stormy Daniels. He is also known for his connections to political and legal figures, particularly in New York. He has served in significant roles, including as a former deputy chief of the Criminal Division of the U.S. Attorney’s Office for the Southern District of New York.

Currently, Trump faces 34 felony charges of falsifying business records. The charges stem from accusations that Trump and his associates used a strategy to suppress damaging information prior to the 2016 election by making false entries in business documents over time. The indictment suggests that each act of falsification was designed to conceal payments made to influence the election, allegedly breaching both New York business and election laws.
