America’s Most Wanted creator John Walsh stated that the trial of Marine veteran Daniel Penny in New York City is the “biggest travesty in the history of this country.”

Walsh appeared on Fox News on Wednesday night to discuss the targeted assassination of UnitedHealthcare CEO Brian Thompson in New York City. Before he began his analysis, Walsh told Fox News host Jesse Watters that he felt compelled to address the trial first.

Penny is currently facing manslaughter charges for subduing Jordan Neely — a homeless man with 42 arrests and a history of threatening passengers — after he threatened to kill passengers on a New York City subway line. Penny then placed Neely in a chokehold and subdued him, with the help of fellow passengers.

Neely was pronounced dead not long after the incident, though he still had a pulse when New York City Police Department officers arrived on the scene. Medical analysis has also determined that Neely’s history of drug use and chronic illnesses could have played a major role in his death.

“It’s the biggest travesty in the history of this country. That guy was a hero,” Walsh told Watters.

The America’s Most Wanted founder — who launched the top-rated program after his son, Adam, was kidnapped and murdered in 1981 — went on to note that there were eight murders on the New York City subway system in 2024.

“And here we’ve got a a marine risking his life to jump on a guy. And then the victim, Jordan Neely, he’s a mentally ill guy, been arrested 27 times. The whole society let him down,” Walsh told Watters. “We’re the richest, most powerful country on the planet. We couldn’t get this guy help. But then they try to turn it into a race thing.”

He went on to state that Penny is a “hero” who should be rewarded for his efforts to stop Neely, noting that he threatened a woman with a young child and vowed to kill her and her child.

“I have a son who lives in Brooklyn he says, ‘dad, those of us that can afford Uber do it, but the people on the subway are people who can’t.’ The  dishwashers and the people coming in the city, it’s a horrible thing that the city of New York is doing to this guy. The DA’s office really needs to be held accountable.”

The jury finished day three of deliberations without a verdict on Thursday.

Penny is charged with 2nd degree Manslaughter and negligent homicide. If convicted, he could face up to 15 years in prison.
