Biden Autopen Probe Takes Jaw-Dropping Turn

Federal prosecutors in U.S. Attorney Jeanine Pirro’s office have quietly dropped a criminal probe into whether former President Joe Biden or his aides improperly used an autopen to sign presidential pardons, according to CBS News.

Two sources confirmed the investigation existed, and one told CBS News the case was ultimately closed after prosecutors concluded they could not find a legal basis to move forward. It remains unclear exactly when or why the probe ended.

The review stemmed from an order issued by President Donald Trump last June, directing federal officials to investigate whether Biden’s White House used an autopen machine to sign major presidential documents, including pardons.

Trump had repeatedly argued that some of Biden’s pardons were illegitimate and raised concerns about who was actually making decisions inside the former president’s administration.

In a memo at the time, Trump instructed Attorney General Pam Bondi and White House counsel to examine what he described as a possible “conspiracy” to “abuse the power of Presidential signatures through the use of an autopen to conceal Biden’s cognitive decline.”

The order pointed to several executive actions taken during Biden’s presidency, including pardons and judicial appointments. It argued that “there are serious doubts as to the decision making process and even the degree of Biden’s awareness of these actions being taken in his name.”

The memo warned that if Biden’s advisers had “secretly used the mechanical signature pen,” it could carry “implications for the legality and validity of numerous executive actions.”

Biden dismissed the allegations at the time, calling them false and “nothing more than a distraction by Donald Trump and Congressional Republicans.”

The decision to close the case marks the latest investigation pursued by Pirro’s office that failed to produce charges against political figures aligned against Trump.

In another case, a grand jury declined to indict six Democratic lawmakers who were accused of violating the law by encouraging service members to reject unlawful orders in a video released last fall. CBS previously reported that not a single grand juror voted in favor of an indictment, an unusual outcome in federal grand jury proceedings.

Pirro’s office has also attempted to subpoena records from the Federal Reserve tied to renovation work at the central bank’s headquarters and comments made by Chairman Jerome Powell during congressional testimony about those renovations.

The Federal Reserve is attempting to block those subpoenas in a sealed legal battle that remains hidden from public view under grand jury secrecy rules, according to prior reporting by CBS News.

The New York Times first reported that the autopen investigation had been closed. CBS News said it has asked the Justice Department for comment.
