BREAKING: Far-Left DA Files Felony Charges Against ICE Agent
Hennepin County Attorney Mary Moriarty announced Thursday that she was filing felony charges against a U.S. Immigration and Customs (ICE) agent in connection with an altercation involving leftist agitators attempting to block his vehicle.
The incident occurred on February 5, 2026, amid weeks of sustained anti-ICE unrest and violence in Minneapolis. Gregory Donnell Morgan Jr., who was identified as the agent by Moriarty’s office, was involved in an encounter on eastbound Minnesota State Highway 62 near the Portland Avenue exit in the Minneapolis area.
According to the Hennepin County Attorney’s Office, Morgan was driving an unmarked black rental SUV on the shoulder of the highway. Moriarty claimed the agent was simply trying to bypass traffic, though the vehicle was being tailed by a local “ICE watch” group, which consist of agitators who follow federal vehicles and impede operations.
As the agent was driving, a second vehicle pulled into the shoulder in an attempt to block him. Once that vehicle returned to the travel lane, Morgan pulled alongside it, matched its speed, lowered his window, and pointed his duty weapon directly at the two occupants while continuing to drive on the shoulder, Moriarty said.
The anti-ICE agitators reported the incident to 911, prompting an investigation by the Minnesota State Patrol. Troopers later interviewed Morgan and his partner at the Whipple Federal Building, while Moriarty described the action as brandishing and pointing the weapon at the individuals.
The incident occurred in the context of Operation Metro Surge, a federal immigration enforcement initiative under the Trump administration that increased ICE activity in Minneapolis and other cities. The operation led to two ICE-involved shootings of agitators, one of whom attempted to run over an agent with her vehicle and another who grappled with agents while reaching for a handgun.
Morgan reportedly told investigators he identified himself as police and instructed the other driver to stop.

Minnesota state law treats pointing a firearm at another person in this manner as second-degree assault. The case is expected to raise significant questions on federal authority, however.
The Supremacy Clause of the U.S. Constitution (Article VI, Clause 2) establishes that the Constitution, federal laws, and treaties are “the supreme Law of the Land.” This doctrine includes Supremacy Clause immunity, which generally shields federal officers from state criminal prosecution when they act within the scope of their official federal duties
Courts have long recognized that states cannot use local charges to interfere with or undermine federal operations. If Morgan’s actions are deemed part of his federal responsibilities — such as responding to perceived interference while on duty in a federal enforcement surge — the Department of Justice is expected to seek removal of the case to federal court.
There, the charges would likely be challenged and potentially dismissed under this immunity principle, as seen in prior cases involving federal agents.
