WATCH: Daniel Penny Says He Has No Regrets In First Post-Acquittal Interview
In his first post-trial interview, Marine veteran Daniel Penny said he has no regrets over intervening to subdue a violent homeless man, who later died, as he was threatening to kill subway passengers in New York City last year .
Penny, 26, sat down with Fox News legal analyst Jeanine Pirro to share his side of the story just a day after he was acquitted by a New York Jury of negligent homicide. He was previously charged with manslaughter — which could have landed him in prison for up to 20 years — though the most serious charge was dropped by the prosecution this past Friday after the jury failed to come to a consensus.

After an additional day of deliberations, Penny was acquitted of all charges in connection with the death of Jordan Neely, a homeless man who had been arrested 42 times. Neely was high on the synthetic drug K2 and still had a pulse when police officers arrived on the scene.
“He was just threatening to kill people. He was just threatening to… go to jail forever, go to jail for the rest of his life,” Penny recalled.
“And now where I’m on the ground with him, I’m on my back in a vulnerable position,” he added, explaining that if he let go, Neely could have spun around and starting attacking him. Penny also had no way of knowing whether Neely was armed or not.
“What in you caused you to want to get involved?” Pirro then followed up.
“I mean, I’m not a confrontational person. I don’t really extend myself. I think this type of thing is very uncomfortable. All this attention and limelight is very uncomfortable. And I would prefer without it,” the Marine veteran answered. “I didn’t want any type of attention or praise, and I still don’t.”
He went on to explain that the only way he would have felt guilty was if Neely acted on his violent threats and seriously injured or killed an innocent passenger. “I would never be able to live with myself,” he said. “And I’ll take a million court appearances and people calling me names and people hating me just to keep one of those people from getting hurt or killed.”
