DC Jury Refuses To Convict Man Who Threw Sandwich At Federal Agents

A jury in Washington D.C. refused to convict a former Department of Justice employee who was caught on camera throwing a sandwich at federal agents before running away. The decision comes after hundreds of January 6 protesters were jailed for trespassing, while others were sentenced to lengthy prison sentences for conduct less than or matching that of the sandwich thrower.

Sean Dunn, a former DOJ paralegal, was arrested back in August after he tossed a subway sandwich at federal agents while they were conducting a patrol back in August. Dunn can be heard calling the agents “fascists” in a video of the incident before he scurried away and was eventually apprehended.

A D.C. jury refused to indict Dunn on federal charges for assaulting a federal agent — a massive deviation from the January 6 cases — prompting D.C. U.S. Attorney Jeanine Pirro’s office to file misdemeanor charges.

On Thursday, Dunn was found not guilty on charges of assaulting, resisting, opposing, impeding, intimidating and interfering with a federal officer. Jurors deliberated for about seven hours before reaching a verdict, Fox News reported.

“I believe that I was protecting the rights of immigrants. And let us not forget that the Great Seal of the United States says, E Pluribus Unum,” Dunn said after the verdict was read. “That means, from many, one, every life matters, no matter where you came from, no matter how you got here, no matter how you identify, you have the right to live a life that is free.”

During the trial, Dunn’s legal team argued that he threw the sandwich as an act of “protest” against President Donald Trump’s decision to federalize D.C. police assets in order to crack down on crime. “It was a harmless gesture at the end of him exercising his right to speak out,” defense attorney Julia Gatto said during the trial. “He is overwhelmingly not guilty.”

Dunn quickly became a hero among left-wing pundits, many of whom essentially viewed trespassing in the Capitol Building as an act of treason. “This is both happy and hilarious,” said MSNBC political commentator Malcolm Nance, who wrote a book arguing that President Trump’s supporters should be treated the same as ISIS terrorists due to the Capitol protests.

Dunn was also praised by the overwhelmingly left-wing residents of the nation’s Capitol, many of whom set up Halloween decorations in his honor.

For comparison, several January 6 defendants were given hefty prison sentences for similar conduct to that displayed by Dunn. Illinois resident Nathaniel Keen was convicted of assaulting Capitol Police officers, a felony, and sentenced to a year in federal prison for throwing a water bottle at police lines.

Dale Jeremiah Shalvey of North Carolina was sentenced to four years for throwing an unidentified object at police, while South Carolina resident Nolan Languerand was convicted of assault with a deadly or dangerous weapon for throwing a traffic cone. For this, he was convicted by a D.C. jury and sentenced to a little more than four years in prison.
