JUST IN: Democrat Congressman Hit With Major Legal Notice After ‘Threatening’ Elon Musk

A high-profile Democrat is in hot water after receiving a formal legal notice from the Department of Justice following controversial remarks about billionaire Elon Musk. Rep. Robert Garcia (D-CA) was sent a letter by U.S. Attorney Edward R. Martin, Jr., demanding clarification over statements he made during a CNN interview on February 12, 2025.

Garcia, while discussing how Democrats could “stop” Musk, said: “What the American public wants is for us to bring actual weapons to this bar fight. This is an actual fight for democracy.”

The comment set off alarm bells within Trump’s Department of Justice, which is now investigating whether the remarks constitute a threat against Musk, an appointed government representative under President Donald Trump’s administration.

The legal notice comes amid ‘Operation Whirlwind,’ a sweeping DOJ initiative cracking down on potentially threatening rhetoric from Democratic lawmakers. The initiative, according to The Washington Post, will scrutinize public statements and actions taken by high-ranking Democrats, including Senate Majority Leader Chuck Schumer (D-NY) and Rep. Garcia, who have been vocal opponents of Musk’s growing influence in federal agencies.

Musk, who oversees Trump’s federal Artificial Intelligence Task Force and the Digital Oversight Government Enterprise (DOGE), has been at the center of Democrat frustrations over what they call “unprecedented access” to federal decision-making.

Garcia’s remarks, however, may have crossed the line from political opposition to outright threats in the eyes of federal prosecutors. In the letter, U.S. Attorney Martin warned that the DOJ “takes threats against public officials very seriously” and requested a response from Garcia by February 24, 2025.

“This sounds to some like a threat to Mr. Musk – an appointed representative of President Donald Trump who you call a ‘d*ck’ – and government staff who work for him. Their concerns have led to this inquiry.”

Following the legal notice, Garcia lashed out on social media, accusing Trump’s DOJ of weaponizing the justice system to silence his criticism of Musk and the administration.

“So if you criticize Elon Musk, Trump’s DOJ will send you this letter. Members of Congress must have the right to forcefully oppose the Trump Administration. I will not be silenced.”

His post quickly went viral, racking up over 2 million views in just hours as left-wing activists and lawmakers rallied to his defense.

With Trump’s DOJ now actively policing threats from Democratic officials, Washington’s political battles are escalating fast—and Elon Musk remains right in the middle of it all.

In a House Oversight Committee hearing earlier February, Rep. Garcia launched into a tirade against Musk and Republican lawmakers, touching on controversial topics, including “d*** pics.” Garcia criticized Republicans for allegedly trying to dismantle government programs and accused Musk of using his wealth to influence American politics.

He referenced Rep. Marjorie Taylor Greene (R-GA) showing explicit images in a previous hearing on Hunter Biden and mockingly held up a poster of Musk, calling him a “d***.”

Garcia also accused Musk of appointing unqualified “DOGE staffers” to government positions and claimed that Republicans and Musk aim to dismantle the Department of Education and social safety programs. Throughout his speech, he painted Musk as a central figure in a broader Republican “power grab.”
