JUST IN: Supreme Court Will Hear Colorado Case Over Trump’s Ballot Eligibility

The U.S. Supreme Court has agreed to review the explosive decision to bar former President Donald Trump from Colorado’s election ballot, which was decided in a tight ruling by the state’s supreme court last month.

The justices will hear the major case on an expedited basis, with opening arguments set for February 8. A decision could come soon after arguments are heard, since Colorado is one of a dozen states that will hold caucuses or primaries on Super Tuesday, which is slated for March 15.

“The petition for a writ of certiorari is granted. The case is set for oral argument on Thursday, February 8, 2024,” the decision said. “Petitioner’s brief on the merits, and any amicus curiae briefs in support or in support of neither party, are to be filed on or before Thursday, January 18, 2024.”

The Colorado Supreme Court’s ruling cites Section III of the 14th Amendment, which bars “former officers” of the United States who have engaged in “insurrection” from holding federal office. The court argued that the former president incited an “insurrection” on January 6, 2021, when he challenged the results of the 2020 election.

Despite the fact that Trump has not been charged with “inciting an insurrection,” the court argued that he did and agreed to remove him from the state’s primary ballot in a 4-3 decision. The state’s high court did stay the ruling pending an appeal, however.

The U.S. Supreme Court decision is expected to have far-reaching ramifications on the 2024 election, as far-left legal groups have filed lawsuits seeking to bar Trump from the ballot in several states. While many of these challenges have been unsuccessful, Maine’s Democrat Secretary of State Shenna Bellows unilaterally decided to remove Trump from the ballot, citing the Colorado ruling.

Groups have also targeted Republican lawmakers who opted to object to the electoral certification in 2020.

If the U.S. Supreme Court opts to strike down the Colorado court’s decision — something that has been predicted by a number of legal analysts — the challenges will be discarded. If the court rules the other way, however, the door could be open for Trump and hundreds of elected Republicans to be removed from the ballot.
