JUST IN: Trump Makes Major Legal Move Against Biden
President-elect Donald Trump filed a blockbuster legal motion on Friday to stop President Joe Biden from making a final move in office that the Republican argued would compromise the country’s safety and lead to another significant influx of illegal immigrants.
Fox News reported on an amicus brief filed by Trump’s lawyers on Friday as part of a lawsuit to stop the Biden-Harris administration’s privatization of the border wall separating the United States from Mexico, joining Republican attorneys general in Texas and Missouri as they challenge whether the president violated a court order in moving to do so. The sale, Trump argued, is “possibly criminal.” The filing adds, “The Court should issue an order directing the Defendants to immediately stop any ongoing sale of border-barrier materials to private parties pending the Court’s review of Defendant’s conduct, and the Court should swiftly conduct a searching examination of the Government’s conduct, by formal discovery if necessary, to examine the Government’s compliance with the law, the Constitution, and the Court’s injunction.”

Since 2023, the Biden administration has been placing parts of the border wall on the auction block, offering private companies the opportunity to construct and maintain critical infrastructure that Trump has promised to buttress after taking office. Previously, President Biden ended all efforts to continue construction on the border wall and only reversed course after the largest ingress of illegal immigrants in the nation’s history, an issue that played a central role in the November election. Biden, the filing states, is “deliberately selling off border-wall materials at a major financial loss to the Government to obstruct the pro-wall policy of Congress and President Trump, such conduct likely constitutes a criminal act, such as a conspiracy to defraud the United States.” It adds, “At the very least, the reported conduct raises troubling concerns of potentially criminal behavior.”

A U.S. Department of Defense official, speaking on background, told Fox that the agency’s hands are tied following the 2024 National Defense Authorization Act, which requires it to “submit a plan to use, transfer or donate all remaining wall material purchased with Pentagon funds.” The plan was submitted in March. Texas was among the first states offered initial rights to purchase materials for those sections of the border wall, and that those materials no longer belong to the U.S. government. “Through our reutilization, transfer and donation process, nearly 60% of those materials were transferred to authorized recipients, including U.S. Customs and Border Protection and the states of Texas and California,” the official said. “The remaining 40% was sold to GovPlanet under a competitive sales contract process beginning in June 2024. The material currently being sold through GovPlanet online auctions no longer belongs to the U.S. Government, and DOD has no legal authority to recall the material or stop further resale of material it no longer owns.”
That hasn’t stopped U.S. House Republicans from accusing President Biden of attempting to undermine the incoming Trump-Vance administration by removing the construction of the border wall from his purview. Senator Bill Hagerty (R-TN) has filed legislation to halt the auctions.
