JUST IN: Trump Notches Huge Legal Victory Over Gavin Newsom

President Donald Trump just notched another victory over California’s left-wing leadership, this time in federal court.

The U.S. Court of Appeals for the Ninth Circuit refused to rehear Newsom v. Trump en banc, leaving in place a ruling that allows Trump to retain command of California National Guard troops he federalized during the Los Angeles protests earlier this year.

In a short order issued October 22, the court said not enough judges supported a rehearing — effectively ending Gov. Gavin Newsom’s latest legal tantrum.

The fight centers on who really calls the shots when chaos erupts on American soil — the president or the governor. By refusing to intervene, the notoriously liberal Ninth Circuit handed Trump a major boost, reaffirming his authority to take control of state troops during domestic unrest.

The case stems from violent protests that broke out in Los Angeles after federal immigration raids on June 6, 2025. ICE agents arrested 44 people and detained up to 80 more after clashes near the Metropolitan Detention Center turned ugly — with objects hurled at officers and federal property damaged.

A day later, Trump invoked 10 U.S.C. § 12406, ordering 4,000 members of the California National Guard into federal service for 60 days “to protect federal personnel performing federal functions, and to protect federal property.”

Newsom cried foul, claiming the president bypassed him and ignored the law’s requirement that such orders “be issued through the governors of the States.” But the courts didn’t buy it.

The Ninth Circuit’s move leaves intact a decision that could reshape the balance of power between the White House and blue-state governors who try to block federal crackdowns.

The ruling also sets a high-stakes precedent: future presidents may now have a freer hand to deploy state-controlled troops when protests spin out of control — whether the local politicians like it or not.

For Trump, it’s another win in his ongoing clash with California’s Democratic machine — and another reminder to Gavin Newsom that, in times of crisis, the commander-in-chief outranks the governor.
