Lefty Lawyers Rip Bragg’s Weak Case Against Trump: “Lacks A Necessary Element”
Democrat lawyers and legal analysts are criticizing Manhattan District Attorney Alvin Bragg’s indictment of former President Trump, saying it lacks a necessary element to pursue felony charges against Trump.
Far-left news sites, such as Vox, expressed disappointment, calling the indictment “painfully anticlimactic,” and stating that Bragg’s case is built on an “exceedingly uncertain legal theory.” Vox writer Ian Millhiser noted that even if Trump did what he is accused of, it’s unclear if Bragg can legally charge him under the felony version of New York’s false records law.
The lack of a clear legal theory and a weak case against Trump has caught the attention of some prominent figures on the left. In Slate’s article titled “The Trump Indictment Is Not the Slam-Dunk Case Democrats Wanted,” Mark Stern writes, “The indictment does not indicate exactly how Bragg plans to connect these dots. It does suggest, however, that the district attorney will attempt to frame the payments as part of Trump’s more expansive plot to suppress negative stories that could cost him the 2016 race.”
Stern continued, “The problem for Bragg is that they’re only misdemeanors, and the district attorney wants a felony conviction.” John Bolton, a former national security advisor, criticized the charges against Trump, calling them “weaker than expected.”
Alan Dershowitz, a Harvard lawyer and supporter of former President Clinton, claimed, “I have never seen a case in my 60 years of practice which has so many holes in it.”
These criticisms are likely to further fuel conservative concerns that Bragg’s prosecution of Trump is politically motivated and not based on sound legal reasoning. Many conservatives have long viewed the ongoing investigations into Trump and his associates as a partisan attempt to undermine the former president and his administration.
Despite the criticisms, Bragg is continuing his prosecution of Trump, arguing that the former president’s actions in the lead-up to the 2016 election amounted to fraud and deception. The indictment alleges that Trump and his company, the Trump Organization, manipulated the value of several properties in order to obtain loans and tax benefits. Bragg has also accused Trump and his company of making illegal hush-money payments to silence women who claimed to have had affairs with Trump.
Trump has denied any wrongdoing, calling Bragg’s indictment a politically motivated attack on him and his supporters. He has also accused Bragg of violating his rights as a private citizen by targeting him for prosecution.
Many conservatives have rallied around Trump, arguing that the prosecution is an attempt to criminalize normal business practices and punish a political opponent. They have also accused Bragg of being a “radical” prosecutor who is more interested in pursuing a partisan agenda than upholding the rule of law.
The outcome of the case could have significant implications for the future of American politics, specifically the 2024 election.
