Letitia James Hit With Bar Complaint Over Comments On ‘Cornell 7’ Case

A bar ethics complaint has been filed against New York Attorney General Letitia James over public statements she made about an alleged sexual assault at Cornell University shortly before her appointment as special prosecutor in the matter.

The National Legal and Policy Center submitted the complaint to the Attorney Grievance Committee of the New York State Supreme Court. It centers on a September 28 social media post in which James wrote, “What this young woman has been forced to endure is horrific and unacceptable,” and added, “To her, and to all survivors: you’re not alone. We stand with you.”

The post came two days before Governor Kathy Hochul appointed James special prosecutor to investigate allegations involving members of the university’s Chi Phi fraternity, known as the Cornell 7.

The complaint argues that the statements demonstrated clear bias by indicating which account of the October 19, 2024, events James accepted before any investigation by her office began. It states that such comments by the state’s highest law enforcement officer on a highly publicized case violate New York rules of professional conduct and compromise the impartiality required of a prosecutor.

Ultimately, the filing calls for James either to recuse herself or to be removed from the matter to preserve the integrity of any review and potential prosecution. The nine-page complaint includes a report from legal ethicist Jack Marshall, who described the alleged violation as “flagrant, obvious and therefore shocking.”

Marshall wrote that it was remarkable for the state’s top lawyer to appear unfamiliar with ethics standards that carry the force of law, and that the post “raises suspicion of a rigged, pre-determined and illicit investigation.”

Separate court documents filed by two of the men named in a related civil lawsuit — Winston Lee and Gillio Lopes — also seek James’s removal. Those filings contend that her statements made clear she had already reached the conclusion that the defendants are guilty.

James addressed the criticism during a debate with Republican challenger Saritha Komatireddy. She described the comments as demonstrating empathy and said that more empathy is needed in politics. She added that “Politics stops at the door in my office.”

A spokesperson for the attorney general’s office stated that in this and every investigation, the office is committed to conducting a comprehensive review of nothing but the facts, the evidence, and the law.

James was appointed on October 1 after Hochul indicated she had lost confidence in the handling of the matter by the Tompkins County district attorney. As special prosecutor, James is charged with conducting a full investigation into the events at the Chi Phi house and, if warranted, presenting evidence to a grand jury.

The underlying allegations stem from a civil lawsuit filed by a woman identified as Jane Doe, who has accused seven fraternity members of involvement in a drug-fueled assault. Two of the accused were expelled from the university and others were suspended following an internal process; none have faced criminal charges to date.
