NEW: AOC Officially Under Investigation, Tom Homan Reveals
Congresswoman Alexandria Ocasio-Cortez (D-NY) is the subject of a federal investigation into allegations that she interfered with immigration authorities and concealed her own hiring of an illegal immigrant, White House border czar Tom Homan announced on Tuesday.
The Democratic darling is “under investigation” for allegedly hiring an illegal immigrant in some personal capacity and on another occasion helping illegal immigrants avoid arrest by officers with U.S. Immigration and Customs Enforcement.
“It’s being looked at, can’t comment past that. I’m aware of it, we’ve asked ICE to drill in on that case,” Homan told conservative podcaster Benny Johnson.
The Trump advisor added that he couldn’t speak more about AOC’s alleged crimes because of the ongoing investigation.
“As far as you know her educating people on how to evade ICE arrests, she’s really educating them on how to be prosecuted…when you knowingly hinder your removal, that’s a crime,” Homan said.
Asked by Johnson how it would be possible for a member of Congress to employ an illegal immigrant in some capacity, Homan replied, “It is not possible.”

No other target of the investigation has been named, but a former staffer to the “Squad” congresswoman has been in the news for going into exile earlier this year.
Diego de la Vega, a former communications aide in AOC’s Washington, D.C. office, stated in March that he would be fleeing the U.S. after 23 years and moving to Colombia. He has been in the U.S. since the age of 7 when he arrived from Ecuador on a visitor’s visa that he overstayed, according to the Washington Examiner.
De la Vega called it “bittersweet” to leave the U.S. now that President Donald Trump is back in office.
“I hadn’t left the country in 23 years—from age seven to age thirty. Now, I can’t go back to the U.S,” he told the media outlet Migrant Insider. “It feels like exile. It’s a very permanent move. But my wife and I are confident we made the right decision. And after some time, it’s been a real pleasure to be here.”
“It feels surreal to not be ‘illegalized’ anymore. I don’t have to live in the shadows or constantly worry about paperwork,” he said. “That freedom of movement is incredibly satisfying. I might not be able to return to the United States for many years—I don’t know how long. But it feels fulfilling to be home.”
A review of De la Vega’s LinkedIn shows he was politically active before joining AOC’s congressional office. He previously worked as an entry-level aide to Rep. Carolyn Maloney (D-NY).
“Diego is amazing,” AOC told Migrant Insider when asked about her soon-to-be-departed staffer. “We love him.”
Homan has previously called for the Bronx Democrat to be investigated after she hosted a “Know Your Rights” town hall in her district that allegedly included instructions about how to avoid ICE.
In February, AOC wrote a letter to U.S. Attorney General Pam Bondi demanding to know if the Justice Department was investigating her.
“I write to request clarity on whether the Department of Justice (DOJ) has yielded to political pressure and attempts to weaponize the agency against elected officials whose speech they disagree with,” she wrote. “Over the past two weeks, ‘Border Czar’ Tom Homan has gone on multiple forums threatening political prosecution against me, citing resources I distributed informing my constituents and the American public of their constitutional and legal rights.”
She said Mr. Homan’s “attempts to use your agency to politically intimidate duly elected officials are a textbook threat to the right to free speech in the United States.”
At her town hall, AOC said she was not bowed by Homan’s threat.
“Come for me,” she said.
