Sotomayor Melts Down After Trump Immunity Ruling, Falsely Claims Presidents Can Now Openly “Assassinate” Their Rivals

On Monday morning, the Supreme Court ruled 6-3 in favor of granting presidents absolute immunity from criminal prosecution for actions undertaken in their official capacity. The decision, deeply rooted in a constitutional debate, had massive implications for the presidency and the legal landscape surrounding the 2024 election.

Justice Sotomayor, joined by Justices Elena Kagan and Ketanji Brown Jackson in her dissent, claimed that the decision undermined the foundational principles of American law. Sotomayor wrote, “Today’s decision to grant former Presidents criminal immunity reshapes the institution of the Presidency. It makes a mockery of the principle, foundational to our Constitution and system of Government, that no man is above the law.”

“Relying on little more than its own misguided wisdom about the need for ‘bold and unhesitating action’ by the President, the Court gives former President Trump all the immunity he asked for and more,” she lamented. “Because our Constitution does not shield a former President from answering for criminal and treasonous acts, I dissent.”

“The Court now confronts a question it has never had to answer in the Nation’s history: Whether a former President enjoys immunity from federal criminal prosecution. The majority thinks he should, and so it invents an atextual, ahistorical, and unjustifiable immunity that puts the President above the law,” Sotomayor wrote.

“Never in the history of our Republic has a President had reason to believe that he would be immune from criminal prosecution if he used the trappings of his office to violate the criminal law. Moving forward, however, all former Presidents will be cloaked in such immunity. If the occupant of that office misuses official power for personal gain, the criminal law that the rest of us must abide will not provide a backstop.”

She finished, “With fear for our democracy, I dissent.”

In April the court heard arguments from Trump’s attorneys stating that his actions involving classified documents and J6, both central to his two federal cases, were protected under presidential immunity. Smith, the Biden Justice Department prosecutor, countered that Trump was acting as a private citizen when he allegedly took classified documents from the White House for his own personal possession and when he encouraged supporters to storm the Capitol in an attempt to prevent Congress from certifying the results of the 2020 election.

“The President enjoys no immunity for his unofficial acts, and not everything the President does is official,” the majority wrote. “The President is not above the law. But Congress may not criminalize the President’s conduct in carrying out the responsibilities of the Executive Branch under the Constitution. And the system of separated powers designed by the Framers has always demanded an energetic, independent Executive.”

“The President therefore may not be prosecuted for exercising his core constitutional powers, and he is entitled, at a minimum, to a presumptive immunity from prosecution for all his official acts. That immunity applies equally to all occupants of the Oval Office, regardless of politics, policy, or party.”

“BIG WIN FOR OUR CONSTITUTION AND DEMOCRACY. PROUD TO BE AN AMERICAN!” Trump exclaimed on his signature social media platform, Truth Social. He later told Fox the decision is a “big win for our Constitution and for democracy.”

“I have been harassed by the Democrat Party, Joe Biden, Obama and their thugs, fascists and communists for years,” Trump said Monday. “And now the courts have spoken.” He added: “This is a big win for our Constitution and for democracy. Now I am free to campaign like anyone else. We are leading in every poll – by a lot – and we will make America great again.”
