Texas Scores Big Victory After Federal Court Smacks Down Biden’s Environmental Agenda

Texas and Attorney General Ken Paxton are fighting back against Biden’s administration. Thanks to U.S. District Judge Jeffrey Brown, it was found that Biden’s revised “Clean Water Act” overstepped its bounds. Paxton went to celebrate on Twitter after Brown, who is a Trump appointed judge, blocked Biden’s extreme “waters of the US” rule, which imposed a “leftist environmental agenda on Texas.”

The Clean Water Act was a federal law that was enacted in 1972 with the goal of protecting the nation’s waters from pollution. The law has been amended several times since then, and in 2021, President Biden took steps to further its provisions.

The legal complaint filed by the Texas Attorney General’s Office against the U.S. Army Corps of Engineers and the U.S. Environmental Protection Agency (EPA) challenged the EPA’s definition of Waters of the United States (WOTUS) under the Clean Water Act (CWA), which expanded the EPA’s authority over bodies of water and wetlands.

Biden’s actions included directing the Environmental Protection Agency (EPA) and the Army Corps of Engineers to review and revise the definition of “waters of the United States,” which had been narrowed under the Trump administration.

Paxton alleged that the EPA’s definition is unlawful, overreaching, and will cause significant harm to the state of Texas by subjecting its landowners to additional regulations and costs. The Texas Attorney General’s Office was seeking a declaratory judgment that the EPA’s definition of WOTUS was unconstitutional and an injunction against its enforcement.

Paxton tweeted, “Big victory against Biden: Last night a federal court blocked the Admin’s radical “waters of the US” rule, which imposes a leftist environmental agenda on Texas, crushing new regs, and oppressive economic costs. I will always fight to keep Biden’s boots off the necks of Texans!”

While the major victory doesn’t win the case, it puts a major freeze on the Biden administration’s ruling as we wait for the Sackett v. EPA decision.

Paxton is an American attorney and politician who currently serves as the Attorney General of Texas. He was born on December 23, 1962, in Minot, North Dakota, and raised in Texas. Paxton was elected as Attorney General of Texas in 2014 and re-elected in 2018. As Attorney General, he is responsible for overseeing the legal affairs of the state of Texas, including representing the state in legal matters, providing legal advice to state officials and agencies, and enforcing consumer protection and antitrust laws. Prior to serving as Attorney General, Paxton served as a member of the Texas House of Representatives and the Texas Senate.
