WATCH: Trump Has ‘Strong’ Defamation Case Against AOC, Legal Expert Says
Veteran trial attorney and legal analyst Alan Dershowitz said during a recent appearance on Newsmax that President Donald Trump “definitely” should sue U.S. Rep. Alexandria Ocasio-Cortez (D-NY) after she falsely labeled him as a “rapist” in a social media post.
The discussion centered on a July 11 X post from Ocasio-Cortez in which she falsely referred to the president as a “convicted rapist.”
Ocasio-Cortez was referring to the E. Jean Carroll case, which was brought using a New York law that allowed statutes of limitations to be waived for civil sexual assault suits from November 24, 2022, to November 24, 2023. The civil trial has long generated controversy as Caroll has failed to provide any evidence of her claim that she was sexually assaulted by former President Trump in a department store more than 30 years ago.
While Trump has never been charged with or found guilty of a crime relating to the matter, a judge ruled that he can be sued for the alleged act. He was ultimately not found liable for sexual assault, but for “defaming” Carroll by pleading his case.
Dershowitz was asked about the post and the possibility of yet another lawsuit related to the matter during a recent interview with Newsmax. “We all know that President Trump was never convicted of rape. Do you think President Trump should file another lawsuit, a defamation lawsuit against this member of Congress as well, sir?” Dershowitz was asked.
“Definitely,” he replied without hesitation.
“It’s a far stronger suit than it would be against the Wall Street Journal, because everybody knows that not only was he not convicted of being a rapist, he was acquitted of that charge specifically. And she’s making it up in the face of knowledge that it isn’t true. So it would be much easier to prove malice against her than to prove it against the Wall Street Journal,” he continued, referencing the president’s recent decision to sue the Wall Street Journal over a bizarre story relating to notorious pedophile Jeffrey Epstein.
“So I don’t see any reason if he’s going to sue the Wall Street Journal why he shouldn’t. No, he’s going to have to sit down and be opposed himself, but he doesn’t seem to be concerned about that because everything about him is public. There are very few secrets left about Donald Trump.”
President Trump recently won a lawsuit against ABC News and network host George Stephanopoulos after he repeatedly referred to Trump as a “convicted rapist” in reference to the Carrol case. The network agreed to pay $15 million, which went towards the president’s future library, and issued a formal apology over inaccurate reporting.
