JUST IN: Judge Reveals MAJOR Decision On Trump Sentencing

A New York federal judge dismissed former President Donald Trump’s bid to transfer his criminal case to federal court on Tuesday. U.S. District Judge Alvin Hellerstein ruled that the former president lacked the jurisdiction to address any potential missteps from the state trial and affirmed that recent Supreme Court rulings on presidential immunity do not alter the proceedings of the New York case.

Trump is set for sentencing later this month. “This court does not have jurisdiction to hear Mr. Trump’s arguments concerning the propriety of the New York trial,” wrote Hellerstein. “Instead, the proper recourse for parties seeking to remedy alleged errors made during a state trial is to pursue a state appeal or, at the highest level, to seek review from the Supreme Court of the United States.”

Hellerstein is a senior United States District Judge for the Southern District of New York, known for presiding over significant cases, including those related to the aftermath of the September 11 attacks. He was appointed to the bench by Democrat President Bill Clinton in 1998. Hellerstein has handled complex litigation involving civil rights, corporate law, and terrorism-related cases.

Trump argued last week to have his case removed from Judge Juan Merchan, citing the Supreme Court’s ruling that presidents are immune from prosecution when exercising core constitutional powers. Trump is seeking dismissal based on this ruling, hoping to leverage presidential immunity. Hellerstein’s ruling suggests that Trump’s argument does not apply in this situation, allowing the case to proceed under Judge Merchan.

“My holding of a hush money reimbursement remains true regardless of who has the burden, whether the People or Mr. Trump,” Hellerstein said according to The Daily Wire. “Nothing in the Supreme Court’s opinion affects my previous conclusion that the hush money payments were private, unofficial acts, outside the bounds of executive authority.”

“There should be no sentencing in this Election Interference Witch Hunt. As mandated by the United States Supreme Court, this case, along with all of the other Harris-Biden Hoaxes, should be dismissed,” he continued. “President Trump and his legal team will continue to fight to move this Hoax into federal court where it should be put out of its misery once and for all.”

“Nobody can believe I am still under a Gag Order from Judge Merchan and, despite being the leading Candidate for President of the United States, I am not allowed to speak about a trial that virtually every well known and respected legal scholar said, “THERE IS NO CRIME.” I DID NOTHING WRONG. WITCH HUNT. RELEASE THE GAG ORDER!!!” Trump wrote on Truth Social on Wednesday.

Trump was found guilty on 34 felony charges tied to falsifying business records, stemming from an indictment by the Manhattan District Attorney’s office. The charges were linked to allegations of hush money payments made during his 2016 presidential campaign to silence claims of extramarital affairs. The payments were reportedly disguised as legal expenses, leading to criminal charges. Trump pleaded not guilty to all charges and has denied any wrongdoing, maintaining that the case is politically motivated.
