REPORT: Jack Smith’s Team Panics, Hires Lawyers Ahead Of Trump’s Inauguration
Biden Department of Justice special counsel Jack Smith — who brought two highly controversial criminal cases against President-elect Donald Trump — is rushing to secure legal representation ahead of anticipated criminal prosecution from the Trump DOJ, according to a report from Rolling Stone.
Citing two sources familiar with the matter and a former DOJ official, several attorneys and staffers who worked on Smith’s team have already retained personal attorneys. The move comes as Smith and his team fear that they could be criminally prosecuted for their work on the dubious cases.

The first case brought by Smith — through which Trump was slapped with multiple felonies for allegedly mishandling classified documents — was tossed by U.S. District Judge Aileen Cannon earlier this year. Judge Cannon argued that Smith’s appointment was unconstitutional, a ruling that Smith vowed to appeal before disbanding his office after Trump’s election.
The documents case was brought despite the fact that Trump’s legal team was in constant contact with the National Archives regarding potentially classified documents. Despite the fact that Trump was cooperating and had no reason to suspect anything out of the ordinary, heavily armed FBI agents with deadly force authorization opted to ransack then-candidate Trump’s home.
Agents then staged a photo op with “top secret” folders to give the appearance that the president-elect was hoarding troves of classified documents, leading to several debunked conspiracy theories about the contents of the documents, including one that falsely claimed Trump was “selling nuclear secrets.” The folders were not included with the alleged classified documents, but were used in a viral photo from the raid.
Smith later conceded in court documents that the photo was indeed fabricated.

Trump had contended that the alleged classified documents were declassified while he was leaving office. The boxes were also kept in a secure, locked room that was kept under 24-hour surveillance.
While Smith opted to bring charges against Trump, a separate special counsel opted not to bring criminal charges against President Biden for the same conduct.
In February, Special Counsel Robert Hurt released his report on President Biden’s mishandling of classified materials. Classified documents were found in a number of homes and office buildings linked to Biden, including an office in Philadelphia and his Wilmington, Delaware garage.
While Hur’s report did find that Biden did indeed mishandle classified documents, the special counsel opted not to file charges after insinuating that the president would likely be perceived as a forgetful, elderly man by a jury. The report elevated concerns over Biden’s mental fitness due to his inability to recall a number of key details about his life, including when he served as vice president and when his son Beau passed away.
