WATCH: Former Head Of DOJ Tax Division Blows The Whistle On Garland, Hunter Plea Deal

The former top tax watchdog for the U.S. Justice Department left the door open for a federal judge to throw out a plea deal reached with Hunter Biden and the federal government that will see the embattled first son serve no jail time in return for pleading guilty to two misdemeanor tax crimes. She added that U.S. Attorney General Merrick Garland’s failure to appoint the prosecutor as a special counsel ensured the more serious charges against Hunter Biden would not stick.

Eileen O’Connor, who served six years as head of the DOJ’s tax division under President George W. Bush, appeared on Fox News to lay out how Garland left David Weiss, the DOJ’s U.S. Attorney for the District of Delaware, without the necessary powers to pursue more serious charges against Hunter Biden in the districts of Los Angeles and Washington, D.C. As a result, Weiss was only able to bring lower-level charges against the Biden son.

“I read Special Agent [Gary] Shapley‘s testimony with deep, deep interest. When I got to page 95, my jaw dropped. That’s where the testimony specifies that as early as June 2021 the prosecution team understood that because crimes must be prosecuted in the district where they occur, Attorney General Garland’s failure to make U.S. Attorney Weiss a special counsel guaranteed that Hunter Biden would not be prosecuted for his tax crimes,” said O’Connor.

O’Connor continued:

“Since 2014 and 2015 [tax violations] had to be charged in the District of Columbia and the later years had to be charged in the district of Los Angeles and U.S. Attorney Weiss is in Delaware, it was clear that without special counsel authority, U.S. Attorney Weiss was not going to be able to charge Hunter Biden’s tax crimes.”

Since the government’s deal with Hunter Biden was announced, AG Garland has steadfastly maintained that neither he nor the White House attempted to influence Weiss’s prosecution of Hunter Biden. However, the lack of special counsel powers granted to Weiss left Hunter Biden with a plea deal that no other person in the District of Columbia has ever received for similar tax fraud crimes.

President Joe Biden has attempted to project a united front behind his embattled son, inviting him to appear at a state dinner alongside AG Garland who maneuvered throughout the room so as to avoid an interaction with the recently prosecuted man. House Republicans are continuing to investigate whether President Biden was aware or tacitly approved of the business activities by his son which precipitated the tax crimes.
