WATCH: Former Trump Attorney Says Prosecution’s Misconduct Could Upend Case: ‘We May Never Get To Trial’

Former Trump attorney Tim Parlatore voiced his shock over the alleged misconduct of the prosecution, stating that the violations are so severe that the case against former President Donald Trump may never reach trial. Speaking on Laura Ingraham’s show Wednesday evening, Parlatore explained what he called a disturbing disregard for attorney-client privilege by the prosecution.

“They’ve shown no regard whatsoever for attorney-client privilege,” Parlatore shared, adding that the prosecution’s approach significantly differed from any other U.S. attorney’s office he had dealt with in the past.

He stated, “They wanted to hear about the searches that we did for additional documents… So I voluntarily went in because, as a criminal lawyer, the opportunity to speak directly to the grand jury, I wanted that opportunity.” However, he says this process was misrepresented by the prosecution, accusing them of insinuating he was withholding information from the grand jury.

“The precedent that Jack Smith is trying to set here is that when clients ask us questions, if we say, ‘no, you can’t do that,’ that’s a crime,” said Parlatore.

In his closing remarks, Parlatore predicted extensive pretrial litigation due to alleged prosecutorial misconduct, which could potentially upend the case. He stated, “I believe this case, there’s going to be serious litigation in the pretrial stage over prosecutorial misconduct by this team, which could entirely upend this case.”

He concluded, “I have problems with any attorney who goes on TV and makes pronouncements about a case that they haven’t seen the evidence,” he stated.

Parlatore played a crucial role as one of Trump’s attorneys during the special counsel investigation over Trump’s handling of classified information. Throughout his tenure on Trump’s legal team, Parlatore has staunchly defended the former president, criticizing the special counsel’s inquiry as “improper.” Despite his unwavering confidence in the case’s merits, Parlatore eventually made the decision to depart from the team.

Attorney General Merrick Garland initiated the special counsel investigation, appointing federal prosecutor Jack Smith to examine Trump’s handling of classified documents at his Mar-a-Lago residence in Florida and his alleged involvement in the January 6, 2021, Capitol attack carried out by his supporters. Parlatore willingly provided testimony before a federal grand jury as part of their investigation into Trump’s handling of classified information.

In addition to his role as Trump’s legal representative, Parlatore acted as the “custodian of records,” overseeing searches for classified documents at various Trump properties. These searches took place at Trump Tower in New York, Trump’s property in Bedminster, New Jersey, and three Florida locations, including Mar-a-Lago, an office in Palm Beach, and a storage unit.

During his testimony, Parlatore leveled accusations of “prosecutorial misconduct” against the Justice Department. He claimed that the department attempted to impede his involvement with the FBI during the document search and exerted pressure on him to divulge conversations protected by attorney-client privilege.
