WATCH: Eric Holder Admits Jailing Trump Would Backfire On Biden

Eric Holder, the former U.S. Attorney General under President Barack Obama, said on MSNBC Tuesday night that voters would come to President Donald Trump’s defense if he were to be jailed by the Biden Justice Department in his federal election interference case.

Speaking with Jen Psaki, Biden’s former press secretary, the prosecutor said while reimposing a gag order in the case was the correct decision by U.S. District Court Judge Tanya Chutkan, jailing Trump for violating the order would produce disastrous consequences for the White House.

“This is already a pretty divided nation, and to do something like that, to take somebody off the campaign trail, to put him in jail, I just would be really reluctant – reluctant to do that,” Holder said.

Holder, who has previously told Psaki that President Trump’s various criminal charges would have a negative “electoral effect” on his candidacy, essentially admitted that the Biden Justice Department may be overplaying its hand in asking Judge Chutkan to threaten President Trump with jail time. The Republican presidential frontrunner has already been admonished for speaking out against co-defendants like Mark Meadows and potential witnesses including Bill Barr, his own former U.S. Attorney General.

“Would a judge actually do that which would happen to a normal person and put somebody in jail for violating an order not to, a gag order? I suspect that’s not likely to happen with this defendant,” Holder added.

President Trump’s legal team has already landed several crushing blows to the case brought by special counsel Jack Smith, who has complained that the 45th president’s continual statements about the case are polluting a potential jury pool should his case go to trial next year as expected. More recently, Smith was forced to withdraw a key subpoena demanding documents related to President Trump’s fundraising efforts around the 2020 election and is rumored to be spending upwards of $25 million annually per case. Smith has charged Trump in a second case related to his handling of classified documents.

Despite Holder’s prediction of President Trump’s electoral downfall, the Republican frontrunner has surpassed President Biden in recent polling and has benefited from a largesse in fundraising as supporters have rallied behind his message that the various legal predicaments amount to “political hit jobs” by Smith.
